14.1 Informal Resolution

We will attempt to resolve the dispute informally within thirty (30) days of receipt of your notice. 14.2 Binding Arbitration

EXCEPT FOR CLAIMS THAT QUALIFY FOR RESOLUTION IN SMALL CLAIMS COURT, ANY DISPUTE, CLAIM, OR CONTROVERSY ARISING OUT OF OR RELATING TO THESE TERMS OR THE BREACH, TERMINATION, ENFORCEMENT, INTERPRETATION, OR VALIDITY THEREOF, OR TO THE USE OF THE SITE OR SERVICES, SHALL BE SETTLED BY BINDING ARBITRATION IN ACCORDANCE WITH THE COMMERCIAL ARBITRATION RULES OF THE AMERICAN ARBITRATION ASSOCIATION (AAA), RATHER THAN IN COURT. THE FEDERAL ARBITRATION ACT (FAA), 9 U.S.C. § 1 ET SEQ., SHALL GOVERN THE INTERPRETATION AND ENFORCEMENT OF THIS ARBITRATION PROVISION.

The arbitration shall be conducted in the English language. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction. The costs of arbitration, including the arbitrator's fees, shall be allocated in accordance with the AAA Commercial Arbitration Rules.

14.3 Class Action Waiver

YOU AND IMOS PIZZA AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS ACTION, CLASS ARBITRATION, CONSOLIDATED, REPRESENTATIVE, OR COLLECTIVE PROCEEDING. FURTHER, UNLESS BOTH YOU AND IMOS PIZZA AGREE OTHERWISE, THE ARBITRATOR MAY NOT CONSOLIDATE MORE THAN ONE PERSON'S CLAIMS AND MAY NOT OTHERWISE PRESIDE OVER ANY FORM OF REPRESENTATIVE OR CLASS PROCEEDING.

14.4 Opt-Out Right

You have the right to opt out of the binding arbitration provision and class action waiver set forth in this Section 14 by sending written notice of your decision to opt out to [email protected] within thirty (30) days of first accepting these Terms. Your notice must include your name, address, and a clear statement that you wish to opt out of arbitration.

15. Term and Termination

These Terms shall remain in full force and effect for as long as you access or use the Site or maintain an account with us. You may terminate your account and your relationship with us at any time by discontinuing use of the Site and, if applicable, contacting us to request deletion of your account.

We reserve the right, at our sole and absolute discretion, to suspend or terminate your account or your access to the Site, with or without prior notice and without liability to you, for any reason whatsoever, including but not limited to:

In the event of a Force Majeure Event, our obligations under these Terms shall be suspended for the duration of such event, and we will use commercially reasonable efforts to resume performance as soon as practicable.
